Welcome to the Olivia Foundation (“we”, “us”, “our”, “The Olivia Foundation”). These Terms & Conditions (“Terms”) govern your use of our websites located at olivia-foundation.org.uk, olivia-comforts.org.uk, olivia-bridge.org.uk, and olivia-nest.org.uk (collectively, the “Sites”), and any related services, donations, fundraising, or interactions via these Sites.

By accessing or using any of the Sites, or making donations or using any related service, you agree to these Terms. If you do not agree, you must stop using the Sites.

1. Interpretation & Definitions

1.1 Definitions

  • “User”, “you”, “your” refers to any person accessing or using the Sites.
  • “Donor” means a user who gives money (or other value) to support our charitable work.
  • “Fundraiser” or “Campaigner” means a user who organises or promotes fundraising for The Olivia Foundation or its projects.
  • “Content” means all text, graphics, images, audio, video, or other materials on the Sites.
  • “Payment Provider” refers to third-party services we engage to process payments or donations.

1.2 Interpretation

Headings are for convenience and do not affect interpretation. References to laws are to those of England and Wales unless otherwise stated.

2. Eligibility, Access & Use

2.1 Eligibility

You must be at least 16 years old (or of legal age in your jurisdiction) to use donation or fundraising features. Users under this age must have parental or guardian consent.

2.2 Grant of License

We grant you a non-exclusive, non-transferable, revocable licence to access and use the Sites for personal, non-commercial purposes, provided you comply with these Terms.

2.3 Prohibited Use

  • Use the Sites in violation of any applicable law or regulation.
  • Infringe the rights of others, including copyright, privacy, or intellectual property.
  • Transmit or upload viruses, malware, or harmful code.
  • Use automated systems (bots, scrapers) without written permission.
  • Misrepresent your identity or affiliation with The Olivia Foundation.

2.4 Termination of Access

We may suspend or terminate access to any or all of the Sites without notice if we believe you have breached these Terms or for any other legitimate reason.

3. Intellectual Property & Content

3.1 Ownership

All content, design, graphics, logos, and materials on the Sites are owned or licensed by The Olivia Foundation and protected under UK copyright and trademark law.

3.2 Permitted Use

You may print or download portions of the Sites for personal, non-commercial use only, provided all copyright and proprietary notices remain intact. Any other use requires written permission.

3.3 User-Generated Content

If you submit content (comments, images, testimonials, etc.), you grant The Olivia Foundation a perpetual, royalty-free licence to use, adapt, and distribute that content in any media. You confirm you own or have permission to share it.

4. Donations, Fundraising & Campaigns

4.1 Donations

All donations are voluntary and non-refundable unless expressly stated. You authorise us to use donated funds to further our charitable aims across The Olivia Foundation and its projects: Olivia Comforts, Olivia Bridge, and Olivia Nest.

Donations may be processed by third-party Payment Providers, whose own terms and privacy policies apply.

4.2 Fundraising & Campaigners

  • Fundraisers must describe their efforts as “in aid of The Olivia Foundation”.
  • You are responsible for compliance with all legal, safety, and licensing requirements for your event.
  • No fundraising activity may suggest official endorsement or partnership without written consent.
  • Funds raised must be transferred to The Olivia Foundation within 30 days of event completion.
  • Activities must comply with the UK Fundraising Regulator’s Code of Fundraising Practice.

4.3 Regulated Activities

Raffles, lotteries, and public collections are subject to the Gambling Act 2005 and local authority regulations. You must secure any required licences before conducting such activities.

5. Disclaimers & Limitation of Liability

5.1 As-Is Basis

The Sites and their content are provided “as is” and “as available”. We make no warranties, express or implied, regarding accuracy, reliability, or suitability.

5.2 Limitation of Liability

To the fullest extent permitted by law, The Olivia Foundation, its trustees, staff, and volunteers shall not be liable for indirect, incidental, or consequential damages arising from the use of the Sites or participation in related activities.

6. External Links & Third-Party Services

The Sites may link to third-party websites or services for convenience. We do not control or endorse them and are not responsible for their content, privacy practices, or policies.

7. Privacy & Data Protection

Your use of personal data is governed by our Privacy Policy, available on each Site. We handle personal information in compliance with UK GDPR and Data Protection Act 2018.

8. Changes to Terms

We may revise these Terms at any time. Updated versions will be posted on this page with a new effective date. Continued use of the Sites signifies acceptance of updated Terms.

9. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
